2. Acceptance of Terms

By using our website or submitting a piece to the Workshop, you agree to be bound by these Terms and Conditions. You confirm that you are at least 18 years of age and have the legal capacity to enter into this agreement.

If you are submitting a piece on behalf of another person, you confirm that you have authority to act on their behalf and that these terms apply to you in that capacity.

3. Services

The Workshop provides three defined services:

Services are delivered in Ipoh, Perak. The Workshop does not currently accept postal submissions. Pieces must be delivered and collected in person unless a separate written arrangement is made.

4. Service Agreement and Scope

No work will commence without a written agreement specifying the scope, estimated timeframe, and price. For restoration services (Service A), the agreement includes an option to halt at the assessment stage at no further charge beyond the initial inspection cost.

Any additional work identified during the course of a service that falls outside the agreed scope will be communicated to the Client before proceeding. Additional work requires a separate written agreement and approval before it is performed.

5. Payment

All prices are stated in Malaysian Ringgit (RM). Payment is due on collection of the piece. The Workshop accepts cash and bank transfer. Payment by other methods may be arranged in advance.

Where a service is halted at the assessment stage (Service A), the Client is liable only for the cost of the assessment as stated in the initial agreement.

The Workshop does not offer refunds on completed services where the work was performed in accordance with the agreed scope and the ledger entry accurately records what was done. Where the Client believes the work was not performed as agreed, they should raise the matter with the Workshop directly within 14 days of collection.

7. Intellectual Property

All content on the Workshop website — including text, images, layout, and service descriptions — is the property of Kemuning Horology or used with permission. You may not reproduce, distribute, or use any content from the website for commercial purposes without prior written consent.

You retain ownership of the piece you submit. Submission for service does not transfer any intellectual property rights to the Workshop.

8. Disclaimers

Watch repair involves working with mechanical components that may be worn, corroded, or fragile. The Workshop will conduct an honest assessment and discuss risks before proceeding, but cannot be held responsible for pre-existing conditions that become apparent only during disassembly.

Timing machine results and water resistance test figures represent the condition of the piece at the time of testing. They do not constitute a warranty of ongoing performance. Mechanical watches require periodic service to maintain accuracy.

The website is provided on an "as available" basis. The Workshop makes no warranty that the website will be free of errors or uninterrupted.

9. Limitation of Liability

To the fullest extent permitted under Malaysian law, the Workshop's liability to the Client arising from any service is limited to the price paid for that service. The Workshop is not liable for indirect losses, consequential losses, or loss of sentimental value.

Nothing in these terms limits liability for death, personal injury, or fraud caused by the Workshop's negligence.

10. Indemnification

You agree to indemnify and hold harmless Kemuning Horology from any claims, losses or expenses arising from your breach of these Terms or your misuse of the website or services.

11. Termination

The Workshop may decline to accept a service submission or website enquiry at its discretion. If a service is in progress, termination by the Workshop will result in the piece being returned to the Client in its current condition, with a refund of any prepaid amounts proportional to the incomplete work.

The Client may withdraw from an agreed service before work commences without charge. Once work has commenced, any withdrawal is subject to the agreed scope terms.

12. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of Malaysia. Any dispute arising from these Terms or from the Workshop's services shall first be subject to informal negotiation. If not resolved within 30 days, the matter shall be referred to the courts of Ipoh, Perak, Malaysia, as the agreed jurisdiction.

Malaysian consumer protection legislation, including the Consumer Protection Act 1999, applies to the extent relevant.

We may update these Terms from time to time. The updated date at the top of this page reflects the most recent revision. Continued use of the website or submission of a piece after an update constitutes acceptance of the revised Terms.
